Uitgebreide producentenverantwoordelijkheid voor het verwijderen van micorverontreinigingen uit stedelijk afvalwater

“De herziene EU-Richtlijn Stedelijk Afvalwater richt zich op het verwijderen van schadelijke microverontreinigingen uit stedelijk afvalwater, zoals medicijnresten en cosmetica. Hiervoor worden lidstaten verplicht rioolwaterzuiveringsinstallaties uit te
breiden met aanvullende zuiveringstechnologieën. Tegelijkertijd wordt de financiering deels bij producenten gelegd via uitgebreide producentenverantwoordelijkheid (UPV). Deze regeling leidt echter tot discussie over reikwijdte en interpretatie. In dit artikel worden de richtlijnvereisten geschetst en worden eerste juridische observaties geboden, mede in het licht van bestaande UPV-regelingen.”

“Harmful micropollutants, such as pharmaceutical and cosmetical residues, microplastics, and industrial chemicals, enter the environment via effluent discharges of urban wastewater treatment installations. To tackle this problem, the in 2024 revised European Urban Wastewater Treatment Directive introduces goals to upgrade urban wastewater treatment installations with quaternary treatment technologies, which aim to remove organic micropollutants. To finance this, the Directive introduces Extended Producer Responsibility (EPR) for pharmaceutical and cosmetical industries. However, in policy briefs and pending cases before the Court of Justice of the EU, several affected producers and other stakeholders have pointed out issues regarding this newly introduced EPR scheme, seeking clarity on its scope and terminology or even requesting its annulment. In this contribution, we discuss the Directive’s EPR requirements and share some first observations based on legal dogmatic analysis as well as critiques contextualized by expert interviews. As such, this article aims to inform practitioners and policymakers and, therefore, contribute to national implementation endeavours.”
